CannaQuest Prizes & Rewards Program 2024 Official Rules

The CannaQuest Prizes and Rewards Program (“CannaQuest”) is sponsored by Native Roots and offered to eligible Native Roots customers. These CannaQuest Official Rules (the “Official Rules”) contain important information regarding CannaQuest and how it works. By participating in CannaQuest, you agree to be bound by these Official Rules and any other term and conditions which may apply. 

Native Roots reserves the right, in its sole and absolute discretion, to cancel, change, suspend or modify CannaQuest or any aspect of CannaQuest at any time.

1. Program Period. CannaQuest will begin on April 10, 2024 at 12:01:00 a.m. MST (“Starting Date”) and will continue until July 31, 2024 at 11:59:59 p.m. MST (“Ending Date”) unless otherwise terminated by Native Roots (the “Program Period”).   

2. Eligibility. CannaQuest is offered by RJJ Morrison, LLC d/b/a Native Roots, 3150 S. Sheridan Blvd. Unit 1, Denver, CO 80227 (“Native Roots”), and is open to retail customers of Native Roots who are twenty-one (21) years or older and legal residents of the United States and the State of Colorado (“Eligible Persons”). Employees of Native Roots, its parent companies, affiliates, subsidiaries, and advertising and promotion agencies, and their immediate family members (spouse, siblings, children and parents, regardless of where they live) and/or persons living in their same household (whether related or not), are not eligible to participate in CannaQuest.

3. Participating Locations. The Program will be run at only the following seventeen (17) Native Roots participating retail locations (“Participating Locations”):

• Native Roots Aspen (Aspen) – 308 S. Hunter St., Aspen, CO;

• Native Roots Boulder (Boulder) – 1146 Pearl St., Suite 200, Boulder, CO;

• Native Roots Colorado Blvd (Colorado Blvd.) – 1155 S. Colorado Blvd., Denver, CO;

• Native Roots Dillon (Dillon) – 850 Little Beaver Tr., Silverthorne, CO;

• Native Roots Vail (Eagle-Vail) – 41290 US-6 B5, Avon, CO;

• Native Roots Edgewater (Edgewater) – 5610 W. 20th Ave., Edgewater, CO;

• Native Roots Frisco (Frisco) – 861 N. Summit Blvd., Frisco, CO;

• Native Roots Grand Junction (GJ) – 683 Horizon Dr., Grand Junction, CO;

• Native Roots Speer (Grant Street) – 500 Grant S., Denver, CO;

• Native Roots Highlands (Highlands) – 2209 W. 32^nd Ave., Denver, CO;

• Native Roots Littleton (Littleton) – 7870 W. Quincy Ave., Littleton, CO;

• Native Roots Longmont (Longmont) – 19 S. Sunset S., Longmont, CO;

• Native Roots North Denver (North Denver) – 620 E. 58^th Ave., Denver, CO;

• Native Roots Santa Fe (South Denver) – 2645 S. Santa Fe Dr., Denver, CO;

• Native Roots Denver Airport (Tower) – 7050 Tower Rd., Denver, CO;

• Native Roots Trinidad (Trinidad) – 3140 Santa Fe Tr., Trinidad, CO;

• The Dandelion - 845 Walnut St., Boulder, CO.

4. How to Participate. During the Program Period, an Eligible Person may participate in CannaQuest by visiting a participating Native Roots retail location and obtaining a CannaQuest Rewards Program book (the “CQ Book”). By obtaining a CQ Book, you are affirming that you meet the Eligibility requirements stated above to participate in CannaQuest. 

5. CQ Book. After obtaining a CQ Book, you may earn Prizes, Rewards, and discounts by completing the various items described in the CQ Book in accordance with the terms and conditions printed in the CQ Book. Additional terms and restrictions may apply.  

6. Earning Prizes During the Program Period. As used in these Official Rules, a “Prize” refers to each of the following prizes found on pgs. 2-3 of the CQ Book which may be earned during CannaQuest at any time during the Program Period.

Restrictions may apply. The half pound of flower is equal to eight (8) ounces and will not be distributed at one time; the winner will be able to collect one (1) ounce, at a cost of $0.01 per ounce, in accordance with regulatory compliance rules regarding daily/personal product transfer limits. The pound of flower is equal to sixteen (16) ounces and will not be distributed at one time; the winner will be able to collect one (1) ounce, at a cost of $0.01 per ounce, in accordance with regulatory compliance rules regarding daily/personal product transfer limits.

A Prize is non-transferable. No cash or other substitution of any Prize will be made, except at Native Roots’ sole discretion. Native Roots reserves the right to substitute a Prize for one of equal or greater value. Native Roots will not replace a lost or stolen Prize or portion thereof. Native Roots is not responsible for any inability of any Eligible Person to accept or use any Prize (or portion thereof) for any reason. Any difference in the stated Average Retail Value and the actual value of a Prize will not be awarded.

7. Issuing Prizes During the Program Period.

a. Prize Winner Selection. Once you accumulate enough stamps to complete a stamp tier found on pgs. 2-3 of the CQ Book (100 stamps, 115 stamps, 135 stamps, or 161 stamps, respectively), show the stamped CQ Book to a Native Roots store manager or assistant store manager for proof of completion. The manager will initial/sign next to the completed tier. Once initialed/signed, you must send a photo of the initialed/signed page to cannaquest@nativerootscannabis.com. After all of the prizes for a particular tier have been claimed, Sponsor will randomly select one (1) entry from the tier winners to win the Puffco Pro(s) for that tier (a “Puffco Winner”). You will be contacted within seven (7) days for further information about your Prize redemption. Once Native Roots has attempted to make contact with you two (2) times, you must contact Native Roots within 24 hours of the second contact attempt to claim the Prize. Failure to claim the Prize within 24 hours may result in Native Roots, at their sole discretion, selecting an alternative winner from the next submission received via email. Prize redemption will be on a first-come first-served basis based on the timestamp of the email you send. The Program Period ends on July 31, 2024. All stamp tier completion redemption email submissions must be sent by July 31, 2024 at 11:59:59 p.m. MST.

b. Required Affidavit and Release. The Prize winners may be required to complete, sign and return to Native Roots and/or its agent, a release and declaration of compliance, and may be requested (but not required) to complete, sign and return to Native Roots and/or its agent a publicity release, within seven (7) days of receipt of such documents from Native Roots. If such documents to be completed and signed by the Prize winners are not returned to Native Roots prior to such deadline, any Prize won may be forfeited in Native Roots’ sole discretion.

8. Earning Rewards During the Program Period.  As used in these Official Rules, a “Reward” refers to each of the following rewards which may be earned during CannaQuest at any time during the Program Period:

• If you shop at one of the Participating Locations on April 20, 2024, you will receive one (1) stamp getting you that much closer to Prizes.

• If you shop at one of the Participating Locations on July 10, 2024, you will receive one (1) stamp getting you that much closer to Prizes.

• If you complete the Mood State Quiz via the provided QR link, you will receive a discount of 15% off your purchase that day.

• If you make a purchase from each of the five (5) Mood State product categories (Energetic, Uplifted, Focus, Relaxing, and Sleepy) you may purchase one (1) Native Roots pre-roll for $0.01 (excludes the Spectra Blunt).

• If you follow Native Roots on social media (Instagram, Facebook, LinkedIn, or X), you will receive one (1) stamp getting you that much closer to Prizes.

• If you shop at one of the Participating Locations during a NR Pop-Up event (eligible event schedule available at www.nativerootscannabis.com/education/cannaquest-2024/), you will receive one (1) stamp getting you that much closer to Prizes.

• If you leave a Google Review of Native Roots online and include #promo in it, show your budtender and you will receive one (1) stamp getting you that much closer to Prizes.

• If you place an order ahead online at nativerootscannabis.com for pick up at any Participating Location, you will receive a discount of 15% off your online order purchase that day.

• If you join our Garden Club loyalty program as a new member, you may purchase a Native Roots pre-roll for $0.01 (excludes the Spectra Blunt). If you are already a Garden Club loyalty program member, you receive one (1) stamp getting you that much closer to Prizes.

• If you make a purchase at one of the Participating Locations on each day of the week (Sunday, Monday, Tuesday, Wednesday, Thursday, Friday, and Saturday) you may purchase one (1) of the following: (i) one (1) 1/8^th of Native Roots flower (Onyx or Gold) for $0.01; or (ii) one (1) gram of Native Roots shatter/wax for $0.01. Note: purchases do not need to be made on consecutive days of only one calendar week.

• If you purchase your daily sales limit of concentrate or flower five (5) times on five (5) different days, you may purchase one (1) of the following: (i) one (1) ounce of Native Roots Green Label flower for $0.01; or (ii) up to eight (8) grams of Native Roots concentrate for $0.01 each gram.

• If you make a purchase from each of the seven (7) product categories (concentrates, edibles, flower, pre-rolls, topicals, vapes, and merchandise) at Participating Locations, you will receive a discount of 15% off your next purchase of $50.00 (pre-tax) or more.

• If you purchase seven (7) 1/8ths of Native Roots Gold, R&D, or Onyx Label flower, you may purchase one (1) 1/8th of Native Roots Gold, R&D, or Onyx Label flower for $0.01.

• If you purchase six (6) 1/2 ounces of Native Roots Green Label flower, you may purchase one (1) 1/2 ounce of Native Roots Green Label flower for $0.01.

• If you purchase the equivalent of four (4) 1/8ths of Veritas, on four (4) separate occasions, you may purchase up to the equivalent of four (4) 1/8ths of Veritas on a fifth occasion for $0.01.

• If you shop at one of our Participating Locations wearing Native Roots’ THC Collection branded apparel, you will receive a discount of 20% off the purchase price of any new Native Roots branded apparel.

9. Issuing Rewards During the Program Period.  Rewards can be issued immediately if verified and signed off on by a Native Roots budtender.

10. Requirements and Restrictions. Native Roots will only issue Prizes and/or Rewards for legally and properly sold and invoiced products in the normal course of trade. Eligible Persons are responsible for providing full and accurate information to be eligible to receive Prizes and/or Rewards. Incomplete CQ Books may be ruled ineligible, in Native Roots’ sole discretion. Prizes and/or Rewards are personal to the qualifying Eligible Person and are not transferable. No substitution or cash redemption of any Prize and/or Reward is allowed, except at Native Roots’ sole discretion. Native Roots reserves the right to substitute a Prize and/or Reward for one of equal or greater value. Native Roots will not replace a lost or stolen Prize and/or Reward or portion thereof. Native Roots is not responsible for any inability of any Eligible Person to accept or use any Prize and/or Reward (or portion thereof) for any reason.

11. Responsibility for Prizes and/or Rewards.  If you become eligible for and receive a Prize and/or Reward through CannaQuest, you understand and agree that you are solely responsible for the Prize and/or Reward, including any and all insurance requirements, licensing requirements, and liability for use.  PRIZES AND/OR REWARDS ARE PROVIDED “AS IS” WITH NO REPRESENTATION OF GUARANTEE OF ANY KIND BY NATIVE ROOTS AND EXCLUDE ALL REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, ARISING BY OPERATION OF LAW OR OTHERWISE, INCLUDING WITHOUT LIMITATION, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

12. Compliance with Laws. Receipt of any Prize and/or Reward offered during CannaQuest is conditioned upon your compliance with these Official Rules and all state and federal laws and regulations.  ANY VIOLATION OF THESE OFFICIAL RULES BY ANY PARTICIPANT MAY DISQUALIFY ANY PARTICIPANT FOR ELIGIBILITY FOR A PRIZE AND/OR REWARD (AT NATIVE ROOTS’ SOLE DISCRETION). If any provision of these Official Rules shall be deemed to violate any state or municipal law, it shall be amended to conform to such law and all other provisions shall remain in full force and effect. 

13. Taxes.  Participants are responsible for Prize and/or Rewards related expenses, including without limitation any and all applicable local, state and federal taxes. When required by federal law, Native Roots will report the names of participants and Prize and/or Reward balances to the Internal Revenue Service, and may require participants to complete, sign and return to Native Roots an IRS Form W-9 to receive a Prize and/or Reward.  

14. Fraud.  Any attempt to commit fraud or misuse of CannaQuest or Native Roots Prizes and/or Rewards will result in participant cancellation. Abuse of CannaQuest or the Official Rules, failure to follow any terms of CannaQuest, any misrepresentation or any conduct detrimental to the interests of Native Roots may result in ineligibility for further participation in CannaQuest. 

15. Other Terms. Native Roots reserves the right to do the following, in its sole discretion: (a) modify, discontinue or cancel CannaQuest at any time, without prior notice, including CannaQuest Official Rules; (b) exclude or disqualify persons from CannaQuest, including Eligible Persons; and (c) make changes to these Official Rules or its other terms and conditions.  Please check and review all Official Rules and terms and conditions to keep informed of any updates and changes. Native Roots is not responsible for lost, late, stolen, damaged, incomplete, invalid, unintelligible, garbled, delayed, not visible or misdirected information or performance submissions, any of which may be void in Native Roots’ sole discretion. By participating in CannaQuest, you agree to and accept, and will abide by these Official Rules and any other posted rules, or terms and conditions applicable to CannaQuest.  Any dispute with regard to the conduct of CannaQuest or a person’s eligibility shall be resolved by Native Roots, in its sole discretion. Native Roots is not responsible for any typographical or other errors in the printing of these Official Rules, other terms and conditions, or administration of CannaQuest.  

16. Privacy Policy. The terms of Native Roots’ Privacy Policy will govern how Native Roots may use your information collected during CannaQuest. By participating in CannaQuest, you agree to the terms of Native Roots’s Privacy Policy.

17. Regulatory Compliance. ALL TRANSACTIONS PURSUANT TO THIS PROGRAM MUST BE IN COMPLIANCE WITH 1 CCR 212-3 RULE 6-110(c). NATIVE ROOTS WILL AT NO TIME TRANSFER MORE THAN THE LEGAL LIMIT OF RETAIL MARIJUANA OR RETAIL MARIJUANA PRODUCT PER TRANSACTION PER DAY AND DOES NOT SUPPORT CONSUMERS POSSESSING MORE THAN THE LEGAL LIMIT OF RETAIL MARIJUANA AT ANY TIME.

18. Termination: Native Roots reserves the right, in its sole discretion and without notice, to cancel, terminate, modify or suspend CannaQuest. Examples of reasons for termination or modification of CannaQuest may include (without limitation) Native Roots’ inability to reasonably or fairly conduct or administer CannaQuest due to business changes, pandemics, malware, security breaches, non-authorized human intervention, fraud or other causes beyond Native Roots’ reasonable control. Native Roots reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with CannaQuest or violates these Official Rules. 

19. HOLD HARMLESS/RELEASE.  BY PARTICIPATING IN CANNAQUEST, YOU AGREE TO HOLD HARMLESS NATIVE ROOTS AND ANY OF ITS PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES AND AGENCIES FROM ANY LIABILITY WHATSOEVER, AND WAIVE AND RELEASE SUCH PARTIES FROM ANY AND ALL CAUSES OF ACTION, FOR ANY CLAIMS, COSTS, INJURIES, LOSSES, OR DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, CLAIMS, COSTS, INJURIES, LOSSES AND DAMAGES RELATED TO PERSONAL INJURIES, DEATH, DAMAGE TO OR DESTRUCTION OF PROPERTY, RIGHTS OF PUBLICITY OR PRIVACY, DEFAMATION OR PORTRAYAL IN A FALSE LIGHT, WHETHER INTENTIONAL OR UNINTENTIONAL) ARISING OUT OF OR IN CONNECTION WITH THE EVENT OR ACCEPTANCE, POSSESSION, OR USE/MISUSE OF ANY REWARD OR PARTICIPATION IN CANNAQUEST.  

20. DISPUTE RESOLUTION: THIS PROMOTION IS GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND THE STATE OF COLORADO WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in CannaQuest, you agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with CannaQuest, shall be resolved INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, exclusively before a court located in Colorado having jurisdiction. You and Native Roots agree to WAIVE A JURY TRIAL in all actions and proceedings relating to CannaQuest. Further, in any such dispute, under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than your actual out-of-pocket expenses (i.e. costs associated with entering CannaQuest), and you further waive all rights to have damages multiplied or increased.
